The New York State Department of Transportation, in accordance with the
Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 U.S.C. 2000d to
2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Of昀椀ce the Secretary, Part 21, Nondiscrimination in Federally-assisted programs of the Department of Transportation and Title 23 Code
of Federal Regulations, Part 200, Title IV Program and Related Statutes, as
amended, issued pursuant to such Act, hereby noti昀椀es all who respond to a
written Department solicitation, request for proposal or invitation for bid that
it will af昀椀rmatively ensure that in any contract entered into pursuant to this

Village of Pomona
NOTICE TO BIDDERS
PLEASE TAKE NOTICE that sealed bids will be received by the Village
Clerk/Treasurer of the Village of Pomona at 100 Ladentown Road, Pomona,
New York 10970 until 11:00 A.M. on June 13, 2025 for the project entitled
“FIELD AND DRAINAGE IMPROVEMENTS AT BURGESS MEREDITH
PARK”. Bids will be publicly opened and read aloud at the aforesaid time and
place.
Consistent with Federal and State mandates, the Village solicits bids from any
and all parties including but not limited to minority and women owned businesses.
Bid documents may be obtained at the of昀椀ce of the Village Clerk/Treasurer,
Village of Pomona, 100 Ladentown Road, Pomona, New York 10970 between
the hours of 9 A.M. and 3 P.M. Mondays through Fridays, exclusive of holidays, on May 15, 2025. Payment of forty dollars ($40) will be required for
each full set of contract documents that are taken, which represent copy, print
and administrative charges, none of which will be refunded. Payment will be
made to the Village of Pomona. Any questions should be directed to the Village Engineer, Spence Engineering at (201) 934-0300.
All bids must be submitted in sealed envelopes with the words “BID FOR
FIELD AND DRAINAGE IMPROVEMENTS AT BURGESS MEREDITH
PARK” on the outside of the envelope and addressed to the Village Clerk/
Treasurer, Village of Pomona, 100 Ladentown Road, Pomona, New York
10970.
All bids must contain a Statement of Non-Collusion in accordance with Section 103-d of the General Municipal Law and a Statement of Non-Investment
in accordance with Section 165a of the State Finance Law.
This contract will be fully or partially funded with Federal Assistance provided to the County of Rockland by the US Department of Treasury under the
American Rescue Plan Act (“ARPA Funds”), Section 602(b) and 603(b) of
the Social Security Act, Pub. L. No. 117-2 (March 11, 2021) and is subject
to certain requirements including 2 CFR Part 200, Uniform Administrative
Requirements, Cost Principles and Audit Requirements for Federal Awards.
Applicable Federal requirements take precedence over State and local requirements unless State and local requirements are deemed to be more stringent.
The Bidder must comply with the requirements of 2 CFR Part 25 Universal
Identi昀椀er and Systems for Award Management (SAM). One of the quali昀椀cations for determining whether or not a business entity is a “responsible bidder”
with the use of Federal funding is that the Contractor must have a Unique Entity Identi昀椀er (UEI) and an active registration with the United States General
Services Administration (USGSA). The UEI and registration are obtained at
www.SAM.gov.
Prior to contract, the bidder must uphold a complete, active registration with
SAM.gov. The USGSA is currently experiencing a delay in processing new
registrations/renewals. It can take up to 30 days or more to obtain a UEI and
complete the registration process. It is highly recommended that the Bidder
obtains at least a UEI number prior to the submission of the bid application.
The Bidder must be willing to sign Federal Contract Clauses at the time of bid.
Federal Contract Clauses will be provided to all bidders and cannot be signed
after a solicitation has been awarded.
Each bid shall be accompanied by a bid bond or certi昀椀ed check in the amount
of 昀椀ve (5%) percent of the total bid to guarantee that if the bid is accepted, the
bidder will enter into a contract for the work and will comply with all requirements of the bid documents.
Bidders are required to comply with all Federal, State and local laws, rules and
regulations relating to all work to be performed on this project.
